Based on information released by Israel, a minimum of 98 Palestinians have lost their lives while in custody starting from October 2023. A human rights group operating from Israel has reported that the true number is almost certainly substantially larger, as a result of many of missing detainees originating in Gaza.

Report Findings

A recent report documented fatalities attributed to brutality, lack of healthcare, and malnutrition. Analysts used transparency petitions, forensic reports, and interviews with attorneys, human rights defenders, next of kin, and eyewitnesses.

Official sources provided complete statistics limited to the opening period of the hostilities. Throughout these months, government statistics show an record fatality rate among Palestinian prisoners, averaging a life lost once every four-day period.

Updated Statistics

Official armed forces most recently revised data on custodial deaths for May 2024, and detention administration in September 2024. Analysts documented a further 35 casualties in detention following these periods and confirmed them with Israeli authorities.

Despite the total number of deaths charted being much greater than earlier projections, it likely fails to capture the complete extent of losses among Palestinians, according to the leader of the detainee affairs unit.

“While we are offering documentation for a greater figure of casualties than earlier indicated, this is not a full picture,” he said. “We are certain that there are yet detainees who lost their lives in detention that we don’t know about.”

Non-Combatant Fatalities

Confidential official information suggests that the vast majority of Palestinian detainees from Gaza who lost their lives in jail were ordinary citizens, per a simultaneous investigation.

In May of 2024, a defense forces registry tracking all fighters in Gaza, a roster of over 47,000 named individuals, recorded merely 21 deaths in detention. By that point, 65 Gazans from Gaza had died in prison.

Detention Conditions

Brutality, torture, and other abuse of Palestinian individuals has become routine across Israel’s jail system throughout the duration of war. Senior officials have publicly referenced starvation rations and an below-ground detention center detaining Palestinian individuals who are denied sunlight.

Current and former inmates and insiders from the armed services have uniformly asserted widespread breaches of global standards.

Organized Maltreatment

The institutionalised cruelty came with a disturbing rise in deaths registered across at least 12 detention centers in Israel. During the previous decade prior to the hostilities, there were typically several casualties a year.

“This does not represent just an individual case sporadically. It is widespread and it is expected to endure,” a spokesperson said, in part due to the fact there is a climate of near total impunity for fatalities and maltreatment of Palestinian individuals.

Only a single instance of assaulting prisoners has reached litigation, with the soldier given a penalty to 210 days. An effort to try others over a vicious assault featuring assault led to public rallies and the arrest of Israel’s senior defense attorney, with the accused individuals now insisting that indictments against them be dismissed.

Absence of Consequences

“In spite of this large quantity of fatalities, during 24 months no one has been arrested,” the representative noted. “There exist no indictments over any death.

“While these measures continue to be enforced, all Palestinian detainees in custody faces risk, even the physically well individuals, even the juveniles who have no underlying conditions.”

Notable Incidents

Some deaths in detention have been publicly known, such as a middle-aged hospital director who perished in prison after 120 days in confinement.

An inmate held with the victim stated that he was taken to the yard by prison staff shortly before his passing, clearly wounded and exposed from the waist down. His remains has not been returned to Gaza.

Further inmates who died in confinement by Israeli authorities stay unnamed. Correctional authorities and defense forces supplied investigators with the number of fatalities in confinement, and basic other details such as the location where they perished, but not the inmates’ personal details.

Identification Challenges

For 21 instances, mostly individuals from Gaza, analysts were not able to match the few details provided by authorities to a casualty documented by human rights groups, either through accounts from former inmates or accounts in the press.

The prisoners’ relatives could be unaware about their relatives’ casualties either, as Israel has created obstacles to monitor Palestinian individuals it is confining. Over half a year at the start of the war, the Israeli military refused to give fundamental details about the status of thousands of individuals detained in Gaza, in effect implementing a policy of forced disappearance, according to the advocacy organization.
